On
February 7, 2002, the Crees signed the "Agreement
Respecting a New Relationship Between the Cree Nation and the Government
of Quebec" that implements certain obligations of Quebec to the
Cree People for community and economic development under section
28 of the JBNQA.
This historic Agreement implements with respect to Quebec recommendations
of the Royal Commission on Aboriginal Peoples and provides for the
sharing of revenues derived from mining, hydroelectric development
and forestry carried out on the traditional lands of the Cree People.
This includes all Category 1, 2 and 3 lands in the area under the
Agreement. The Agreement, and related agreements with Hydro Quebec,
are designed to address historic problems in achieving equitable
participation of the Cree people in the employment opportunities
and revenues created by development on the traditional Cree territories.
Chapter 6 of this Agreement is the chapter dealing with Economic
and Community Development and presenteed below.
Assumptions by the Crees of certain James Bay and Northern Quebec
Agreement Commitments:
6.1 For the period from April 1, 2002 to March 31, 2052, the Crees
shall assume the obligations of Québec, Hydro-Québec and the Société
d'énergie de la Baie James to the Crees under the provisions of
the James Bay and Northern Québec Agreement set forth in section
6.3 of this Agreement and concerning Economic and Community development.
6.2 The assumption by the Crees of the obligations described in
paragraph 6.3 of this Agreement for the period from April 1, 2002
to March 31, 2052 is made in consideration of the funding committments
of Québec under Chapter 7 of this Agreement and subject to the
payment by Québec to the Crees through the Recipient of Funding
of the annual payments provided for in Chapter 7 of this Agreement
in accordance with the terms thereof.
6.3 The obligations of Québec, Hydro-Québec and the Société d'énergie
de la Baie James contemplated by paragraphs 6.1 and 6.2 hereof
relate to the following provisions of the James Bay and Northern
Québec Agreement:
a) Economic development:
- 28.5 and 24.3.24: Cree Trappers' Association (operation, capital
and programs);
- 28.6: Cree Outfitting and Tourism Association (operation);
- 28.7: Cree Native Arts and Crafts Association (operation and
programs);
- 28.11.2 a): an Economic Development Agent per community;
- 28.12: assistance to Cree Entrepreneurs.
6.4 The Crees shall carry out the obligations set forth in section
6.3 hereof in accordance with the applicable legislative and regulatory
framework of general application such as following applicable construction
codes and submitting projects to environmental and social impact
assessment where applicable.
6.5 The provisions of this Agreement respecting the provisions
of Section 8 and 28 of the James Bay and Northern Québec Agreement
described in section 6.3 hereof and the funding thereof do not
affect nor are they intended to affect in any manner the obligations
and commitments of Canada in the James Bay and Northern Québec
Agreement including all those set out in Section 8 and 28 thereof.
